What if Trump Gets Indicted?

Most prosecutors will not bring cases to trial that they do not believe they can win, especially indictments against a high profile target. And you don’t get higher profile than an ex-president. If they lose they risk career suicide. But if they win, they immediately gain power and prestige. The fact that so many prosecutors appear to be preparing indictments against a former president is a strong indicator that they believe they can convict.

First, the congressional subpoenas for Trumps’ inner circle

Let’s start with congressional subpoenas. Trump and his circle of possible co-conspirators are starting to get subpoenas from the House committee investigating the events leading up to, and the day of, the January 6th insurrection. These subpoenas mean two things: they must supply documents related to their actions and they must appear for questioning in front of congress.

Trump has not yet been subpoenaed and he is already claiming executive privilege to avoid testifying. However, it is the nearly universal legal interpretation that executive privilege can only be claimed by the sitting president, in this case Joe Biden. But Trump has another card he will play…
